Burstein and Bagdanov Prevail in Two Contested Bankruptcy Trials

  • On November 3 and 4, 2016, Richard Burstein and Jessica Bagdanov represented David Seror, chapter 7 trustee, as plaintiff in a contested trial in bankruptcy court before the Honorable Maureen Tighe, United States Bankruptcy Judge. The trial involved disputed questions of law and fact about the nature and circumstances of contested fraudulent transfers, the defendant’s relationship with the debtor, and the circumstances under which the defendant received the transfers. After trial, the Court made extensive findings of fact and conclusions of law, and entered judgment in favor of the trustee and against the defendant for roughly $1,500,000.
  • On November 29, 2016, Richard Burstein and Jessica Bagdanov represented David Seror, chapter 7 trustee, as plaintiff in a contested trial in bankruptcy court before the Honorable Victoria Kaufman, United States Bankruptcy Judge. The trustee was seeking turnover orders and a determination that a parcel of improved real property (the subject of litigation and multiple transfer documents prior to bankruptcy) was property of the bankruptcy estate. After trial, the court prepared an extensive written decision and gave judgment to the trustee, decreeing that the property indeed belonged to the bankruptcy case, and awarded turnover orders and post judgment attorneys’ fees to the trustee and against the defendant of approximately $92,000, plus costs.
