Mark Brutzkus Quoted in Los Angeles Business Journal on Design Infringement Lawsuits
BG Law Partner Mark Brutzkus was heavily quoted in Cale Ottens’ Los Angeles Business Journal article “Legal Patterns,” which discusses the complex issues surrounding copyright lawsuits in the clothing industry, as well as the negative impact these suits have on fashion and textile businesses. According to Mark, these types of claims can be extremely difficult to fight, and it is often impossible for fashion designers to know whether they are inadvertently using a copyrighted design.
“The fashion industry is a trend-driven business,” Mark said. “If the current trend is a single floral design on a T-shirt, there are only so many variations of a single floral design. How do you figure out – based on where the petals are and the leaves are – if you’re infringing on someone else’s design?”
