Ronald Abrams’ article “Apple May Ultimately Regret Its Success in Apple v. Samsung” was published by IP Watchdog on August 16, 2016. In the article, Ron discusses the potentially devastating impact an Apple win in the Supreme Court case Apple Inc. v. Samsung Electronics Co. Ltd., over total Galaxy smartphone profits, would have on business and technology. An award of “total profits” of the phone, rather than “apportionment” based on Samsung’s infringement of Apple’s smartphone shell, would mean that Samsung might have to disgorge all Galaxy profits to Apple. The aggressive stance by Apple to recover all profits, rather than a portion based on the shell infringement, could backfire since Apple might one day have to defend its “total profits” for a minor infringement.
